Pennzoil v Texaco? Point being is there ever a case where the party not in privity to a marriage contract is completely passive and not in some way interfering with the marriage contract?

 

Personally, I would love to see the doctrine of tortious interference applied to marriage broadly, even via statute, as opposed to the old alienation of affection actions. That's one law I could get 100% behind in the current environment.

If my recollection is correct, tortious interference requires some sort intentional inducement to break the contract, so it wouldn't work in my example where the married person is making the offer. I think there's an old common law tort for "seduction" that is similar to what you propose.

 

Would you also like to see some sort of claim for tortious interference with prospective marriage relationships? Then we could head into court everytime some woman gets dumped by her boyfriend. . ..

Granted it was a one time thing and the hubby knew (it was a threesome) but still.....he could consciously choose to have sex with some other man's WIFE. :sick: The couple has the right and the choice to bring others into their bedroom and that's fine. I'm just so upset that my BF would choose to take part in that. And he said he did NOT use protection the whole time. I made him get STD tested long ago but still.....GROOOOOOOOOOOOOOOOOOOOOOSS. :sick:

My ex's affinity for male hookers came between me and our better or worse vows. Turns out he also had an affinity for violence. I would understand if this was something the BF did back in his wild experimental youth but he switched gears after the last break up and did all this stuff right before he met me. That would be an awful quick change back.

 

Okay, now we're getting somewhere. You had an ex with an affinity for male hookers and your current boyfriend had a threesome with another guy. Yes, you have plenty to worry about, but "cheating" is not the issue. Are you sure he only had sex with the wife?

The married person could not be making an "offer" in the legal sense, as adultery is against public policy, among other reasons. If the OM/OW incites the married person in material ways, that is the very definition of interference in that adultery is a breach of the marriage contract in a common law sense even if statutes provide for no-fault divorce.

The single person is doing nothing wrong. They have no commitment or obligation to anybody and if a married person offers it why not take it? Morality is going the way of the 8 track these days anyway so why not do what you want?

As much as some of your post drive me bonkers, I really do see how you could think women suck. Days like today make me think men suck.

 

It's going to take a couple of days of "deer in the headlights" for me to process this one and then I can come back and read this thread without giving myself a heart attack by thinking about it.

 

When he got home tonight I told him that had we not been living together I would have shown him the door the second he admitted that to me. He didn't have a response to that and I can't venture a guess as to what he was thinking.

 

I just can't shake the disturbed thoughts.

For me, this kind of statement has never held water. You could also say:

 

  • Someone's going to rob these rich people's house; it might as well be me!
  • I might as well drive this getaway car for the bank robber. If I don't do it, he'll just find someone else. I might as well make some money instead of them!
  • I might as well spraypaint this wall. If I don't do it, some tagger punks are going to do it instead.

 

This makes sense. I know it sounds horrible but more and more I am starting to think the world is just shot to hell so why not get your piece of the pie any way you can?

I understand the sentiment and sometimes feel this way too, but in reality, the world has always been shot to hell (living under the Romans, Atilla, Gengis Khan, Hitler, Bush :p come to mind)...

 

and living that way would be anarchy and would mean I am a scum bucket, and at least I want to feel that I still have some integrity even if no one else does. I have to live with myself and die by myself in the end.
