I have been separated for years and now finalizing my divorce. My ex is in another country and no plans of coming back :). But I am trying to do a simplified divorce through an online service and they all ask the following question:

 

Is your spouse willing to sign the divorce papers with you?'

 

We both want it and both willing to sign them but not physically together. It will all have to be through mail. Am I reading too far into this? Can I go ahead with legalzoom/completecase?

 

Any help will be appreciated.

Contact the clerk of your court and ask what their requirements are for authenticating the signature of a respondent who is signing a settlement while out of the country. They'll give you the right answer for their court and filing procedures. Get it wrong and they'll kick it back to you.

Don't be penny wise & pound foolish. Hire a real lawyer. Divorce is not a DIY Project. The last thing you need is to find out you did it wrong & you're not divorced.

 

Documents can be countersigned at different times. I think the Q was will this be a contested or uncontested divorce. If your STBEX is willing to sign, it's uncontested because you have agreed on the specifics of your split.
