JamesLK Posted November 3, 2013 Posted November 3, 2013 So here's the situation: If a couple is together for just about 2 years and they sign a 1 year lease on a apartment together. The rent is $1100 + Electricity ($60) + Parking ($60). If they break up, does the person who leaves the apartment still have to pay rent? I'm sure it's a yes because BOTH names are on the lease. But how much rent does that person have to pay? If prior to the breakup that person was only paying $400/month, is that what they would continue to pay or would they have to do 50/50? If you were in this situation would you make your ex keep paying for (half of) your apartment, even though they no longer lived there? Or just cut all ties?
Janni Posted November 3, 2013 Posted November 3, 2013 Legally, they'd have to pay 50/50. If I stayed at the apartment and my ex moved, I would pay 100% myself. Everything else is unfair and bitter. But that's just my opinion..
Balzac Posted November 3, 2013 Posted November 3, 2013 Every lease spells out terms for breaking the lease. Utilities may as you describe it are separate from the lease.
AlmostFrench Posted November 3, 2013 Posted November 3, 2013 Well technically you have agreed to pay 50/50 but who is going to do that if they don't like there? I'd say you both have to pay half each until you find someone else to move in and cover the other half of the rent.
