Spanking your child in California may soon

Be grounds for arrest. How do you all feel about this new law they are trying to pass?

 

IMO In California there are a lot of children killed by the hands of their parents. Mostly younger males whom are not the fathers. But from blunt trama. Little babies mostly not even a year old. I can see someone wanting to put a law out there like that. I get so heart sick when I hear these terrible stories. :(

spanking will lead to arrest? thats rediculous! a parent owns his or her child and should be able to do whatever they want to it. the child is their property.

A child is not the parent's property - that is wrong to say that. Just because they gave you life doesnt mean they can do whatever the hell they feel like with their child and use that as a reason to justify their actions.

Uncontrolled anger is the result of child abuse and murder...it's interesting that the state wants to step in, as the state says it's legal to murder a baby before birth and during birth....murder is murder period....

Although I'm not a fan of physical punishment, a smack on the bottom doesn't strike me as outwith the bounds of unreasonable chastisement. I do feel, though, that once a parent gets into the habit of using and justifying physical forms of punishment, there's a risk of boundaries being crossed and reasonable chastisement turning into something that's rather more abusive. On the other hand, I think it's unacceptable to criminalise something like spanking. There's too much potential for reasonably well functioning families to be thrown into chaos, disruption and division by the practical implementation of those laws.

 

It seems unlikely that dry pieces of legislation can offer parents guidance as to what's reasonable and what's not as far too many humanistic issues and variations are involved. In any case, if someone is the type of parent who abuses their child as a result of anger, mental health problems or substance misuse, a legislative provision saying "children should not be smacked" really isn't going to stop them. There are limited welfare resources in every society, and these are the cases - ie where children are seriously at risk - that resources need to be directed towards. Not cases where a child has, for instance, been smacked on the hand as a warning for placing his hand towards an electric fire. When the law becomes overly rigid and prescriptive about things like this, it's a recipe for such misdirection of resources to become rife.

I don't know about this.

 

There is a certain age where you may have to spank the child. They are old enough to be punished but not old enough to be able to have a mature discussion with. Personally, I would ground my child or may them sit in the corner before I would consider spanking, but that is just me and my opinion. Unfortunately, a handful of adults are unable to control their anger and may turn spanking into something worse, so I can see why the state of California would be concerned.

I agree. Well done, ahsumgurl909.

 

It's about time that spanking got put back on the agenda. And, whilst we're at it, let's make parents apply for child-rearing licences. This is clearly the way forward, to a brand-spanking-new future of hope. No child left behind, and all that.

This brief article outlines some of the content of the bill, which seeks to criminalise the spanking of children younger than three, introducing punishments of either one year in jail or $1,000 fine.

I tend to agree with this...

 

It is more than ironic that a politician who wants to make it illegal for parents to apply their flat hands to their babies' bare bottoms is more than happy to allow the heavy hand of the law to yank parents from their homes and place them behind bars for disciplining their children in the way which they see fit and does not injure a child.

 

A child's interests aren't served by breaking families up in this manner. That's an absolute last resort that should only be turned to when the alternative involves leaving the child in an environment where it's liable to suffer significant emotional or physical harm.
