1AQUARIAN
Has anyone used a quit claim deed? I had my ex sign it and am ready to record it. My question is this, Does it have to say soamewhere on the deed that this was due to a divorce???? Thanks!
Wolfp
I suppose it would depend on what the state's requirements are. I am looking at mine from NC that I still have to deliver to DW and it doesnt say anything about it being due to a divorce nor did my attorney who drew it up tell me it was necessary. All he said I needed was a sig, and a notary to notarize it, then I could file it with the county clerk.
melodymatters
and it doesn't matter ( at least here) WHY the quit claim deed was executed. Just know that whoever is on the mortgage is still liable for the debt. My ex made me refinance ( even though I paid for everything and had much better credit ) because he didn't want to stay on the note (mortgage) before HE would sign a quit claim deed. Hope that helps.
