tracie Posted August 12, 2006 Posted August 12, 2006 im trying to get a divorce from a very violent ex. ive gone through all the correct channels and he's ignored ALL the divorce papers that have been sent. i had to hire a process server to serve him by hand which he did successfully. the process server then had to go to court to swear that hed served them on my ex. the court said that he had 8 days to respond to the divorce and if he didnt then it would go to the next stage. my ex hasnt seen a solicitor during this time and he apparently has an appointment with one on monday which will be his 1st appointment with any solicitor about the divorce. the 8 days that he had to respond by are up on wednesday. my query is because its his 1st appointment on monday,will they be able to contest the divorce in time? secondly, can he stop the divorce happening after the 8 days have elapsed.......someone help me with my problems please
superconductor Posted August 12, 2006 Posted August 12, 2006 It's very likely that your ex and lawyer will request an extension. Whether they'll get one or not is entirely up to the presiding judge, and that's a crap shoot. Whether he can actually stop the divorce from happening is something that you should discuss with your solicitor. Most likely, he can't, but it's really dependent upon your jurisdiction and the applicable laws.
