Thank you everyone who answered my first post. :bunny:

My head has been saying leave from the beginning. So I am. Now, does anyone have any experience of leaving someone who you have a mortgage with? Ive been searching the internet and cant find anything.I just want to release his share and get him out of my life!

Is it messy? How long does it take?

You need to talk to your bank to see if they will increase your loan, thus allowing you to buy his share in the house. If your own bank won't do it, then talk to another bank. You need to establish what the market value of the property is, and the determine how much he is entitled to - 50/50 or whatever. You need to do your sums carefully. If the house is also in your joint names, then he needs to transfer his share of the ownership to you. Talk to your lawyer, who will explain in more detail.

 

You need to get as much legal and financial advice as possible so that you can make the right decision.

I think you'll be glad you did but by all means, consult an attorney. Be aware that if he refuses to give up/sell his share of the house to you then either he'll have to buy you out or the house will have to be sold and the equity divided appropriately. That may mean having to take the issue to court.
