mopar crazy Posted January 27, 2006 Posted January 27, 2006 If the father of the child(ren) moves out of state for a job and his exW and child(ren) stay in the same state in which they lived during the M who pays for the trip for the father to see his children for visitations? Obiviously w/ the father living out of state over 1,200 miles there probably wont be an every other weekend visitation court order. Would the courts order that the exW pay for the transportation for the children to go see their father out of state? If so, what if the exW can't afford to pay for an airplane ticket or the gas to take their children for visitations. Would a judge court order the exW to pay for transportation and if she can't afford it she will go to jail for contemt? My sister in law's exH lives out of state but their son never goes to see him, the father comes here for visitations a few times a year.
Curmudgeon Posted January 27, 2006 Posted January 27, 2006 the laws of the state in which the divorce took place. Very often, the parent who moves out of state must pay the transportation costs for visitation since they're the one who moved and, thus, created the expense. In other cases, the transportation costs are split between the custodial and non-custodial parent. As for going to jail for contempt over transportation costs, highly unlikely. Most of this can be negotiated during settlement.
