What can I do to get my former employer to turn over my pay stubs?

In my job, we were never given pay stubs on paper but had to download a phone app in order to get them. However, the phone app would never work. I worked there fore about six months and I had all this other stuff going on in my life at the time, that I thought to myself, well I'll just check the bank to make sure the money is always going in, which it did, and that will be good enough until I can get this app thing figured out.

 

I asked though if there was another way to get the stubs, but they told me that the only way is through the app. So I got laid off recently and now applying for unmemployment insurance. But in order to do that I need to give them the pay stubs as well as a record of employment. And in order to do that, the only option to rely on an app that I can get to work.

 

I am thinking maybe I should just spend the extra money to speak to an attorney to see if he/she can subpoena the employer to turn over everything. That way it's all on him and I don't have to rely on an app I can't get to work. Any thoughts on if this is a bad idea?

I can't imagine engaging an attorney would be cost effective in this instance - their fees would probably be more than your unemployment checks.

 

Go to the government website of your jurisdiction and read up what the laws are regarding this, most likely the employer must provide hard copies when requested.

 

I would send a certified letter to your old employer asking for the information before investing in an attorney.

Well the employer already told me that the only is through the app, so how should I ask him with the next letter then?

do you have any ex co-workers you can contact to help you with the app? if you know the app's name you may be able to find support on the internet.

Well I don't know any of those co-workers numbers or last names really. The app asks for a password and then when I type it in, it says its incorrect. Well I haven't even been able to set up a password yet. So how can it be wrong, when it wouldn't have even allowed me to choose one in the first place. That's the current obstacle.

it may have locked up. try to install the app again and start over

A subpoena would take time and money to obtain.

 

Have you tried contacting the app company?

 

Send the certified letter before wasting money on attorneys. You're better off just trying to get a new job lined up than going that route.

 

I don't think you understand how expensive attorneys are, or how long it takes to get court orders.

No there is no option for that. Well it's just that if I ask before they say to refer back to the app. I'll send an letter to the app company but I don't have a lot of faith that will do any good.

Ask the employer for the password, they set it up when they set up the payroll account.

I know when we set up ours they used everybody's ss# or the last 4 digits as the password.. not sure if they still do that kind of stuff anymore.

 

Someone in the accounts payable department will be able to help you.

Oh okay, I thought I was suppose to choose the password, and thought that the app was preventing me from doing so.

 

However, the old password that the employer has is now useless, since I requested a new one. They keep saying they will email me a new one, but it hasn't happened yet, and I've tried a few times now. What then?

ironpony, even if you are no longer employed by them legally they still have to help you figure this out. next time you talk with someone be sure to let them know that you're thinking of filing a lawsuit over this matter. that should light a fire under someone

Exactly. The app comes with a default password, you get it from your HR or benefits department.

 

ironpony, are you comfortable sharing the name of the payroll service (ADP, Paychex, etc) or the name of the app?

The name of the app is Powerpay. Well I requested them for a new password so now any old password they might have had is no good now. However, they still haven't emailed me a new password yet...

 

I suppose I could threaten with a lawsuit, if I don't get a new password, but still want to remain on the employers good side if I can.

Ask the people at unemployment for the citation to the law that says the old employer has to give you the pay stubs. Then armed with that info drive yourself over to your former employer's place of business during business hours & go into the office. Explain to the people there that the app isn't working for you & politely ask the person to use their desk top to print out the pay stubs.

 

My employees get their pay stubs this way but I have a different access path on my desk top computer & can get them info if they having trouble with the system. Somebody in the office where you used to work can get this info for you if you ask politely & in person.

Okay thanks. I didn't use the citation before, but I did go down there and ask them to print them off. They said they don't have them though and that the app company is the one who has all that information though.

Payroll should be able to access the website and your payroll records! When you go to the office, remember to never take "No" from someone who cannot tell you "Yes." In other words, if the secretary has a canned "We cannot help you. Go to the payroll website" response, make sure you talk to the actual payroll person. If they tell you no, talk to their supervisor. SOMEONE in that company can help you. They just don't want to because they've been taught to say "You can access it yourself on the website."

I hear what you are saying, but trust me, if authorities come to that company and want to see payroll records, they're going to show them payroll records. Someone in their HR or Payroll or Accounts Receivables department DOES have access to those records.

Call the company, ask to speak to the HR department, explain very clearly simply that you need to access the pay stubs and you can't get the app to work.

 

DO NOT MENTION ANYTHING ABOUT LAW SUITS.

 

They will help you. If you make their lives difficult, they will not go out of their way to make yours easier, so just be businesslike and clear.

okay thanks, but I already asked the HR department and he was the one who says that the app has all the records, and need to access it through there.
