If you have a legal separation with paperwork written up with a lawyer, does sex with someone else still count as adultery???!!! 2. I had a legal separation with paperwork, but then I moved back in for a little while. Now do I have to start all over again with the living apart for 1 year before we can divorce???? It counts as 'criminal conversation'. 2. It depends - you'll want to talk to your lawyer or get some legal advice on that. Link to post Share on other sites
