2ndX Posted October 29, 2015 Posted October 29, 2015 If he leaves the country to visit a sick relative, can I continue the divorce proceedings without him being served? Can I tell him before he leaves and just do all the work myself? Or do I have to get all that paperwork done before he leaves the country?
PegNosePete Posted October 29, 2015 Posted October 29, 2015 It would be advisable to get him served ASAP. If he's likely to leave soon or to try to avoid service, then I would skip the normal steps of postal service, and go straight for personal service by a process server. Once he has been served you can do everything yourself. If you don't get him served, and he doesn't return the paperwork, then it's probably still possible for it to go through... but it would cost a lot more, both financially and time-wise. It's very difficult to successfully use deemed service without a lawyer.
