A friend's boyfriend dated a girl who he didn't know was underage. Can he go to jail?

My friend who I knew for a couple years and close to told me her boyfriend is in this predicament with an ex girlfriend who is underage, 16 years old. The story is her boyfriend was dating his girl for 6 months that he didn't know she was underage. He met this girl through a friend and this friend lied about everything and also this girl lied about her age. The mother supported the relationship knowing the age difference. The girl later revealed that she is underage and that's when my friend's boyfriend ended the relationship. Now this girl is threating him and whatnot because he doesn't want nothing to do with her and it's causing so much stress on him and trying to meet with her mother to straighten up this mess but she keeps postphoning it.

 

My friend is scared she might lose him and I'm always there to support her so I came on here to ask for some advice. Thanks

It depends. In some states there are exceptions when the age difference is within a certain range. For example an 18 year old dating a 16 year old is usually OK. Outside of that, it's a problem, a 21 year old dating the same 18 year old.

 

 

Another issue is sex or sex like conduct (touching, oral etc. ) If there was no sex it was probably OK. Dating isn't the crime; touching is.

In most U.S. states it is perfectly legal for a 16yo to enter a sexual relationship of her choosing with any adult of any age provided the adult is not in a supervisory or authoritative position over the 16yo.

 

So check your local laws before you panic.

Just out of curiosity - how does one even have relationship without knowing each others age?

 

For adults there's really no difference whether you're 32 or 34 and I'm not saying that you should suspect everyone that they are lying. But 16yo should go to school and do things that teenagers do. How is it possible that it never comes up what the girl does during the day, what classes she's taking, what are her future plans etc? Gap between 16 and 18 is quite big in terms of personal development.

Well he is 27 and the girl is 16. I'm wondered the same thing too but I'm guessing he trusted the wrong person who introduced them. He said it was a friend that's how they met.

The age difference makes a lot of difference.

 

In New York State, a person who is under age 16 but older than 13 years old can consent to sex with a person who is no more than 4 years older; the crime of the 3rd degree rape only happens when a person over the age of 21 has sex with a person who is under seventeen years old or younger and that person can or may be punished with up to 4 years in prison. The younger the victim is, the more severe the punishment.

 

Of course, it doesn't matter that the mother approved, or not.

Does he have anything that could prove she lied about her ago? Text, email, letter, anything?
