My husband lives with me even though I've asked for a divorce. I tried to initiate a separation in the spring and he became "stalker like". I won't get into the the details but it fit the description I read about what constitutes stalker behavior. My question is if he behaves like this when I actually file what can I do? By law he has a right to live here, it is his legal address. I can't leave because it is a mother daughter house, owned by my mother. Would I be able to get a restraining order? I don't know how to continue the process but I don't want to stay married just so he won't stalk me.

You're asking for legal advice on a board that I doubt anyone is qualified to respond. You're in New Jersey, right? Have you consulted with a lawyer? You really need to. What sorts of behavior may qualify for a restraining order is going to vary quite a bit from state to state, and to a certain extent from judge to judge in the close cases.

Yes, I'm from Jersey. I'm not looking for legal advice, just wondering if anyone had had a similar situation and what they did about it. I left a message to arrange a consultation with an attorney. Unfortunately I can't talk at work and he's always around when I'm off. It's very hard to find free time that attorneys are available when my husband isn't around. I really don't know where to go or what to do.

What evidence could you give authorities that proves your safety is in jeopardy?

None at the moment. But in the spring when I first asked he started following me. He parked and waited for me to get off the parkway them he followed all around town. He tried to block me in at one point and got out of his car and threw he's cars and phone at mine. He was peaking in my window one night after I went to bed. And another ones startled out of sleep when he came crawling in the bedroom, probably trying to get my cell phone. He's done things like that. There's more, all along those lines. I know it will escalate when I actually file papers.

If you are physically afraid, call the police.

 

 

Call a lawyer during your lunch hour or break at work. During that initial brief conversation you can set up a time for a longer call.
