If you were a Mom of an 8 year old boy and you worked from 2 pm to 10... What would you do regarding custody... When his father doesn't work at all during those after school hours.

 

 

Would you give up fight on. 50: 50

Custody ?

 

Or would you try to quit your 6 figure career to stay home with your son

Wasn't like that in the past. The mother was usually considered the primary custodial parent. But now, family courts are FINALLY recognizing the importance of having both parents in their lives equally.

 

 

Therefore, I would think that the courts would probably award custody at 50/50. But, each state is different and each judge is different as well.

50/50 is a reference to time (as in completely equal hours). This is different than joint custody, where parents can still have highly lopsided time sharing such as 75/25.

 

 

Which are you referring to when you say "50/50"?

if you work and he doesn't then could he have his time with his son during those hours? or at least have him look after him so you're not worrying about a babysitter?

I would sit down with your stbxh and negotiate a schedule that works, is as fair as possible and PRIMARILY benefits the child.

 

I got D with a 6 figure salary 50/50 custody - but I traveled. Hard to travel as single dad of two - so I quit, took different job that paid WAY less...but was 9-5. That's just me though....

Family courts are starting recognize the importance of a father's presence in a child's life and playing an active role other than just a child support payment. So the are starting a award equal time with the children. Therefore, 50/50. split evenly or whatever is agreeable to both parties.

Nothings wrong with 50/50 custody. I actually applaud that arraignment.

 

 

A lot different than 20-30 years ago where Mom was the custodial parent and the ONLY thing the courts were concerned with in reference to the fathers rights to the children is that he makes his monthly child support payments. Whatever he could get out with visitation was just a bonus.
