The age difference is small enough, and the younger partner is 16+, so as far as "sex with a minor" goes, this is considered a less serious offense. (Not like a 40 yo man with a 12 yo schoolgirl.) As a practical matter, your sexual relations are very unlikely to become a matter for the courts UNLESS... ...there is a pregnancy or transmission of a serious/fatal STD ...the parents of the younger person find out and get angry ...the younger person becomes very disgruntled and decides to press charges However, I hope that you perceive constraints on your behavior other than the purely legal kind. The age difference is enough that the older partner may have more control, and the younger partner may end up getting hurt or feeling used. Just something to think about. Does "tx" mean transvestite?

According to the law, you are not legally old enough to give consent; therefore, any sexual act an adult (anyone of legal age) has with you is "non-consensual" and considered to be statutory rape.

For whatever reason, the offense traditionally known as "statutory rape" is not prosecuted very often when the child victim is older than 14 years of age and the sex is consensual. However, the laws prohibiting any form of sex with children under the age of 17 are still on the books, and it is within a prosecutor's discretion as to whether or not he or she wishes to pursue such charges against an individual. A cynical person might argue that such decisions are usually politically motivated. Section 22.011 (a) (2) of the Texas Penal Code provides that a person who has sexual relations with a child younger than 17 years of age is guilty of Sexual Assault. Under this section of the Penal Code, "sexual relations" may include conventional sexual intercourse, oral sex, anal sex and/or oral-anal sex. The most important thing to note about this criminal statute is that it does not actually require any assault to take place. Thus, an adult who has consensual sex with a child under 17 years of age is guilty of Sexual Assault, even if the child was the one who initiated the sexual encounter. In addition, it is not a defense to prosecution that the adult mistakenly believed that the child was 17 years of age or older. This statute does not apply if the adult and child engaging in sexual conduct are legally married. Also, if an adult who has sexual relations with a child can show that the child was 14 years of age or older at the time of the encounter, and that the adult is no more than three years older than the child, he or she cannot be convicted under this statute. Generally, an offense under this statute is a felony of the second degree, punishable by two to twenty years in prison and a fine of up to $10,000.00. If, however, the child victim is under the age of 14, the offense is enhanced to a felony of the first degree, punishable by imprisonment for life or for a term of not more than 99 years or less than five years, and a fine not to exceed $50,000.00." I guess I should add that you are at higher risk if: * the two of you are of different races * you live in a county where the governing officials want to make a point about sexual morality or law and order My basic advice to you would be to find a girl closer to your own age. You're safer in a lot of different ways. If you do stick with this girl, YOU better be responsible for birth control. Don't just take her word, or you could be hit with a child support suit. That's a huge millstone around your young neck. Also beware of STDs, and always use a condom, preferably with a backup method of BC like the pill or Norplant. Go with her when she gets the Norplant inserted.

If the young man in question was here in Britain he's be fine. Age of consent is 16. If he was the girl, no one would bat much of an eyelid, since it is widely deemed more socially acceptable for an older male to be with a younger female than vice versa. Although, all of that said, Britian has horrific rates of teen STD'sand pregnancies and i really think that the increased sexualisation of children is quite tragic. We have 15 year olds who come to our club asking for pole dancing lessons!
