My boyfriend (OH) is going through a divorce… The lawyer is pretty useless and also refuses to talk to me saying that I am not his client…I think it is because he knows that II'm onto him……my boyfriend is useless with figures and just wants to bury his head in the sand over the whole issue.. It seems that last week his lawyer in my OH's absence has agreed in court to give her a particular % of his pension… For example; Say he takes no monthly pension and instead takes the full lump sum…he would get 500,000….divide that by the number for years he would have served (35) = 14,285…. times that by the number of years they were together (22) = 314,285 then divide by 2 = 157,142…. So she would get 157,142…… now if that is what it has to be then so be it….we will have to make decisions on how much money to commute based on what we need to give her nearer the time (he has 6 years until he retires)… The problem is this…both sides have requested a clean break….but how can it be a clean break when the money we have to give her will keep on rising…..am I unreasonable by saying that it should be calculated from today not from when he retires? He has already gone from a constable to a Sergeant during the time they have been divorced (nearly 7 years) and she will be getting a lot more due to that….so why should she benefit from any further promotions? This is not a clean break…..I feel sick everytime I think about it….we have forms on my desk right now to fill in for his bonus (can't remember the name of it but when you've been in the police for so long without problems you can apply for a wage increase)…it is probably only 50 quid a month after tax but its pensionable…but all I can think about is that by doing that we're upping her money…… We had plans for y OH to go for Inspector next year…..we were excited about it…hoping to recoup some of the obey that we know we would have to pay his ex….but now the excitement has gone because it will sack her entitled up by a lot…..and its making me ill… Surely this cannot be right….surely we have a right to appeal for a clean break and the calculations to be made from today?
