Chi townD Posted September 3, 2013 Posted September 3, 2013 In most cases, all assets are marital until AFTER you are legally separated, regardless of whose name is or isn't on the asset or the debt associated with it. If you aren't legally separated, it may not matter a hill of beans that you (or she) took her name off of anything. Well, two things. They aren't even married. So, the only obligation he has is to the kids (aside from assets gained together as a couple). And the other, this guy writes as if he's in England. If this is the case, then he would have to follow British law; which, I know I'm not familiar with.
aliveagain Posted September 3, 2013 Posted September 3, 2013 I'm in Canada, we base our laws on English Common Law. We have the Dower Act which protects a spouse(male or female), any interest of the married person will vest or may vest in any other person at any time. You don't have to be married to get half of the assets, living together may suffice. Please talk to your lawyer.
Author chevy383 Posted September 3, 2013 Author Posted September 3, 2013 I have spoken to my lawyer and common law marriage or wife or husband is a myth and doesn't actually exist, in i liable for my kids which of course is my responsibility she isn't entitled to any maintenance for herself and cant touch my pensions, thank Christ we didn't get married! i couldn't believe i bumped into one of who i thought was another family friend tonight whilst shopping and i asked if she knew and she said yes even about the affair all she could say is it happens so best for people to move on, in convinced women turn into devils as they get older!
2sunny Posted September 4, 2013 Posted September 4, 2013 Women don't turn into devils as we age. Either you're a person of strong, stable character - or you're not! Gender and age has nothing to do with a person being a jerk or not. When evidence shows a person is a jerk - it's best to remove the jerk from your life as much as possible. Male or female! 1
Author chevy383 Posted September 5, 2013 Author Posted September 5, 2013 Sorry to offend you but that is how i feel, i have given this woman everything, still cant believe even her friends are accepting what shes done, not one of them have critised her, these are people i thought were my friends as well but not one has said she has done anything wrong. Our other friends cant believe what has happened and have commented they have seen her change and cannot believe she wants to break up our family, just wish she would try telling them and they could talk some sense into her
