ver13 Posted March 18, 2013 Posted March 18, 2013 Each judge will approach D matters in their own way, I mean use the law as a general guide line but they are human. Look no matter who stays joint custody is generally what happens unless either party can be legally proven to be unfit. The choice by either spouse to leave the family is just that a choosing of their own design. One of you has to go if you plan to get D or stay and work it out.

Search for "Alaska child custody," for example. I agree with first responder that each judge is different and that you'd have to be proven unfit to lose custody rights. Most judges still rule to keep kids with their mother, but attitudes are changing toward equity in parenting.
