I think it depends on the people and situation for example if a guy has been flirting with a girl all night at a party and decides to slap her on the butt then she may enjoy it as it would build more sexual tension.

Now in a situation in which a guy just slaps a girl's butt without the flirting even if they are friends she is more likely to hate the butt slap unless she happens to be the type who is very promiscuous.

This CAN be construed as SEXUAL ASSAULT! A number of factors must be in place, but this can be seen as sexual assault.

 

Too many people don't FULLY understand the statute that describes what does and doesn't constitute assault and that's why work places have to constantly mandate such training every year.

 

1. There was UNSOLICITED or UN-INVITED touching

2. It occurred in the workplace

3. It was clear that she did not enjoy the touching. This could lead to discomfort or perceived/actual hostile workplace.

 

Now from what you describe, we don't know if this was the first time he'd done this or with other ladies. If there is a pattern of such behavior, oh heck yeah, sexual assault.

 

I personally don't consider that sexual assault. If he put his hand on bum or boob, then the word 'sexual' could come into play, but an arm on the shoulder, uh-uh. I have had this happen to me by women at work or after work and that still falls within the work practices guidelines where I live and I would never dream of rushing to HR to file a sexual assault charge, because I felt threatened. Yes it was unsolicited but not unwelcome...that is until she jabbed him in the ribs. Then he knew he had over stepped the boundary. If he does it the 2nd time, then its clear its unwelcome and point 3 comes into play.
