My ex sent me an email today letting me know that she has instructed her solicitor to send the divorce petition to me. Apparently its going to contain some upsetting things i would guess reasons why she wants to divorce me - it sucks I know its going to hurt to read that stuff and whats more the fact that she is filing against me is a kick in the teeth as I never wanted divorce, she did but it became obvious that her social life and not wanting to change her behaviour was of far more importance than our marriage. I'm not saying I was perfect but those of you who have read my other posts understand that there was more to it.

 

It also sucks becuase despite how crap she was in the end and the fact that she clearly doesnt give two ****s about me i still love her. I still get that weird feeling in my stomach whenever she makes contact and when its something nasty it just makes it worse - surely after three months I should be stronger than this?

 

Should I care that she is filing against me, whats this petition likely to say?

"You could have filed yourself. So now she filed. The only reason you might care is the very slight upper hand she has as being the first person to be in the position to make requests for discovery. The petitioner get s to come first - and you are the respondent (that is, DEFENDANT). Personally, I felt being petetioner was a stronger position, especially for my EGO. Some may think that silly, but it does factor in whether you like it or not. That is why you are possibly feeling "taken off guard" or a bit surprised, or whatever weird feeling you are experiencing. Wait till the paper arrives in your hand!

 

Actually, I think it's rather nice she gave you a head's up. My former spouse did the same thing. My attorney beat his attorney to the courthouse at 8am the very next morning. You could try the same thing - sometimes opposing council drags their feet. There could still be time to give her a big monkey wrench to chew on. But you have to act first thing in the morning and say nothing. Another way to pull it off, after-the-fact, is to countersue her on grounds. I don't know your story, so I don't know if you have grounds or not. YMMV state to state, however, grounds seem to be available - even in "no fault" states, they have not been totally eliminated, don't let anyone mislead you on that. Get legal advice.
