I Am Willing to Give Her the House: Advice?

Hello,

 

I have been in discussions with my wife about divorce for 10 months now and the big sticking point is our house. We live in Texas, and Texas is a community property state. My wife refuses to sell the house and has used that issue as a stall tactic to keep me in the house. My thoughts initially were that I needed to get my share after the sale and all credit card debts were cleared. By my estimate my total net may be only 10K-15K.

 

For the sake of my sanity and staying any longer, it's just not worth it. My thoughts are then to just sign over the house. She will no longer kick and scream that I'm trying to "throw her out of her house!" If I sign over the house she can't accuse me of doing just that. I just want to move on with my life.

 

Does anyone here know how to actually "sign over" a house? Is this something my wife and I need to do through the mortgage company, so that my name can be removed from the mortgage?

Just hire an attorney to assist you with the process, you'll sign a quit claim. Yes, you must make sure your name is off the mortgage so you're in the clear. She will most likely have to refi in her name only on the mortgage. Just get an attorney, a couple hundred bucks max to make sure all is proper and legally you're off the hook. Not difficult at all.
