So my wife and I separated (physically, not legally) almost a year ago and she moved out of state. Does she have any claim to the money I have made in the past 11 months since she has been gone? We initially split out joint account when she left.

I would say no. But you should seek legal aid to know what your rights are and how to protect yourself.

Did / do you have a seperation agreement, a pre-nuptial agreement? Even these can be challenged and over thrown in court in front of the right judge.

 

Depends upon what state your in, she's in, which state the divorce is being filed in? Seperation, pre-nuptial aggrements drawn up and filed in one state don't and won't necessarly hold up in another, such as Tom Cruise's wife filing for divorce in New York state and old Tom trying to get it moved back to California.

 

As sstated you need to seek the advice of a real attorney and not some inter-net lawyer want-a-be or thinks-he-knows-it-all.
