Him not admitting to his habit isn't a false statement since he expressed nothing one way or the other. Lying by omission isn't a lie at all.

So if a spouse cheats but they don't tell - its actually not a lie because they with held THAT TRUTH? NO WAY! If I rob a bank but don't tell - I still robbed the bank! And yes, the lie happens when a person with holds truth. THAT is deceiving! It's INTENT is to deceive by not telling info! It IS a lie...

If I have a severe drinking problem but don't tell - I am still intending to deceive another by covering up what is real = a drinking problem! But if I omit my truth - yes, it's a lie... I intend to deceive!

Anything short of truth is a lie! Lying by omission is the most sneaky way to make someone think a different way than what's real! It's cruelty at its highest level... Leaving the other left "wondering" what's actually real.

Lying by omission is still a lie..But HE DID lie because when he got caught he said his phone had a virus and tried to lie and lie his way out of why I would have gotten that text. That is a bold faced lie ..the other is a lie by omission on a very important fact that he engages in 3-4 times a week. Either way the trust is gone.
