My husband told me he wanted a divorce, been out of the house (and state) since Sept.

Today he told me sometimes he acts like he wants to work things out just to avoid paying the full amount of child support because he doesnt want to have to pay the full amount of child support. He is suppose to owe 800-900 dollars a month. He wants to only pay 200 dollars (we have 2 children together. One who is 3 1/2 and one who is almost 6 months old). 200 dollars a month really isnt much for 2 kids. My oldest son is by another man and he pays 365 a month just for one kid. So now i am extremely angry and hurt that he said this to me, so now i am fully done and want to get the divorce ball rolling.

Should i even bother filing for limited divorce or should i wait and file for absolute divorce? I filed for child support already and it has not gone through (its been almost 2 months and i have only gotten 100 from him so far). i dont want to just not have anything file because right now we have not filed anything. I want sole physical and legal custody of my children. He can have visitation but i want full rights to my kids. I deserve them. He is barely involved. So i want everything i can get as far as my kids go. That is why im debating about filing for limited divorce.

I'm sorry I don't have specific advice to give. I think that you need to speak to a legal professional. Your options may depend on your state and its laws.
