carhill Posted October 4, 2011 Posted October 4, 2011 We worked through MC first, then decided to divorce as a result of that process and then settled up and arranged our property for the most cost-effective divorce. Time from first disclosure to divorce filing was about 22 months. In a D-day situation (cheating), IMO it would depend upon the cheating spouse's response. More positive actions to prioritize the M and work to reconcile, more delay. Less positive, less delay. In Cali, we have a 'cooling off' period of six months, so you could file tomorrow and still have no final judgment for six months, even if all the proper paperwork was filed. Our D took about 18 months. Plenty of time for reconciliation after filing, as long as both parties are willing and able.
AudentesFortuna Posted October 4, 2011 Posted October 4, 2011 I'm filling today. 4 months after our separation. She said she wanted the divorce no matter what but she hasn't done anything since separation. I'm tired of waiting so I'm taking it upon myself to do it. I didn't want to do it, it was her doing and she should have gone through the pain that is the paperwork but in the end, I have to look out for myself. She didn't file so I will.

If your spouse is really out to screw you over they can financially. The minute the papers (for separation) are filed, you are no longer responsible for any debt they aquire.
