sillyfish Posted August 22, 2011 Posted August 22, 2011 Hi, I'm in my divorce process. My stbx husband asks me to declare a diamond ring (about $6,000) that he gave me as a gift before we married. Does anyone know what the family law in ontario (canada) says about gift from the spouse before marriage? Thank you very much. Fish
fltc Posted August 22, 2011 Posted August 22, 2011 That's a question your attorney should answer, he's the one who knows the law, right?
cavedweller Posted August 22, 2011 Posted August 22, 2011 fish, Take it and hide it in your back yard and tell him you lost it.. my 2 cents

Fish Give it back and be done with it, why hold on to something that in the end won't mean anything when your in your new M.
marqueemoon4 Posted August 23, 2011 Posted August 23, 2011 At least in the states any gifts you gave each other before the marriage have nothing to do with marital property. He has to chalk that up as a loss.
itllgetbetter Posted August 23, 2011 Posted August 23, 2011 Fish: marqueemoon4's correct - a gift BEFORE M is yours alone.
PegNosePete Posted August 23, 2011 Posted August 23, 2011 In the UK all assets, whether given as gifts or not, go into the marital pot. That doesn't mean they're necessarily split 50/50, it means they are up for discussion. Who retains then will be based on many factors. Not sure how it works in Canada. I second cavedweller's idea, tell him you threw it in the canal in anger and if he wants it back he is welcome to get a wetsuit and go find it.
cavedweller Posted August 23, 2011 Posted August 23, 2011 fish, You can do the same thing with any spare cash..Hide it and tell him you spent it on clothes, drugs or booze..
