abe1927 Posted May 26, 2011 Posted May 26, 2011 I expect to get divorced soon. If I receive an inheritance before the divorce, will that be divided the same as any other marital asset?
just_some_guy Posted May 26, 2011 Posted May 26, 2011 this is a question you need to ask of your attorney. The laws in various states and nations are different on this matter. In California for instance, the answer is no, inheritance is not part of community property. In other state or nations, this may not be the case. Consult your attorney.
Eeyore79 Posted May 26, 2011 Posted May 26, 2011 Can you not postpone accepting the inheritance until after the divorce?
just_some_guy Posted May 26, 2011 Posted May 26, 2011 Can you not postpone accepting the inheritance until after the divorce? Probably not. Failing to disclose a marital asset may result in forfeiture. Again, this is professional territory. Consult your attorney.
