My husband's ex was given the family home in the divorce agreement, with 18 months with which to refinance it out of my husband's name. She has not done it yet, though the period she was given has passed ("I'm doing my best!", "Working on it!", general excuses and knowing her she's done nothing). Has anyone been in this situation? What remedies are available to the former spouse still tied to a home they no longer have access to, yet could get destroyed by if the other former spouse decides to stop paying the mortgage on or something? Is this a state-by-state thing?
