Exactly. What the guy did was against the law, period. Everyone can argue about right and wrong, should've/shouldn't have, but it's still illegal and the prosecutors are within their rights to press charges. It's a risk you take when you access someone's email, forum, eBay, online banking accounts without authorization. If you get caught, and someone presses charges, tough titty. That the other person is a cheater doesn't make everything acceptable and legal. If people are that concerned, they should contact their state legislators and suggest adding an "unless they're a cheater" to the statutes. You're doing exactly what this idiot of a prosecutor is doing. Taking laws which are meant to protect corporate data and/or classified materials, and applying them to a husband and wife's relationship. Those laws are not meant for this kind of thing. Okay, let me present a Lifetime movie hypothetical. Wife has been physically and emotionally abused by husband for years. She uses Google to find a support forum for abuse victims and gets some referrals for therapists, a women's protection shelter, and lawyers. She saves all that information and all her private message notifications in her email account. She contacts some people who are going to help her and sets up an arrangement for getting out. Abusive husband stumbles across a scrap of paper where she had her forum password written down, checks the cache, finds the forum, logs in, reads everything, tries the same password on her email account, gets in, and reads every bit of information. He lashes out at her, and she ends up staying put. Would it be a misuse of the statute for the state to tack on the same charge the Michigan man is facing? Did she give up every single privacy right when she said, "I do"? Hey, if she's trying to figure out how to escape a physically and verbally abusive marriage, she doesn't have the right to get help privately. He's entitled to read all her emails, right? Is he entitled to listen to every phone call, as well?

That is, IMO, what you were doing, and I think it's relevant to point that kind of thing out. You brought in unrelated issues - "radical" feminism, satanism - and tried to pretend that they were part of the topic. You got called out on it, and are now trying to make this about you the person. But it's not. It's about the gaping holes in the arguments you were trying to make. Those have been repeatedly pointed out to you. If you want to address them, please do.

Maybe the lawyers you know, and who are willing to give you free legal advice without really knowing anything about the details, aren't very good ones.

It is interesting to note that the law was enacted in 1979 at the very dawn of of the modern personal computer age and well before email was a unuiversally accepted method of corresponding. As recently stated by State Rep. Tom McMillin : "It's hard to believe that Oakland County Prosecutor Jessica Cooper would waste significant taxpayer money on this situation," McMillan said. "There are murderers and thieves out there to harass and aggressively prosecute, yet she goes after Walker. I wonder if she intends to start a special unit to begin investigating husbands' and wives' computers across the country."McMillan said "that after reviewing the state law in question (the Fraudulent Access To Computers, Computer Systems and Computer Networks Act 53 of 1979) it is clear there was never an intention for the law to be used to go after spouses." Thanks for the back ground info on Cooper. None of which seems to show her as either a satanist or a prostitute and seems to conflict with some feminazi agenda she might have what with trying to pin murder on a non murdering woman and NOT catching crime committing men for their real acts . And still it went sailing right over............quotes the whole post as though it supports bizarre allegations. I think I found a new resolution.
