UK jails people for False Date Rape claims? Why not U.S. too?

It's a really tough situation. Actual rapists should get the death penalty. False accusers should be thrown in prison for quite a long time.

 

Hard to differentiate between them, though.

 

I agree with this. However, it comes down to proof. By then the damage is done.

 

A female can ruin a mans life just by walking into the local police department and filing a report.

 

Man is at work having a great day at work, lunch with his co-workers, then the police arrest him on his job.

 

No due process, your are coming with us. End game.

:confused: why would say something like that? This is just ASKING for a stir. :mad: No female said anything and I doubt they would have. Accusing someone of rape is just as bad as rape itself.

 

No. I'm genuinely surprised it hasn't happened yet. Not only because of the attitudes of some of the posters here, but because of how society views rape in general. Every accused rapist is guilty until proven innocent, and is still guilty afterwards regardless of what the actual outcome of any prosecution or litigation. I suppose my perspective is a bit tainted because I'm very familiar with underground punk culture, and pretty much every female that adheres to that music scene is a radical feminist who believes in BS concepts like "rape culture." Regardless of my perspective, society as a whole does not view accused rapists in a kind light. I feel like accused murderers get off better in the PR sense.

I would also like to add one more thing in regards to what happened with my friend's case.

 

It ruined him financially as well. Every amount of money he had saved went to his lawyers (yes plural) to save him from a false accusation. I chipped in, his parents chipped in, friends, and relatives all hard earned cash spent on a farce.

 

Her. She didnt have too spend much of anything as far as we could tell. She had womens groups and organisations to help as well as a donations for her legal fund.

 

Sorry, speaking of this gets me worked up. I am still so angry over it.

That is horrible! He could've gotten a pro bono lawyer though, right? Nevertheless, I think that there should be some compensation by the government (better yet, by the accuser) for these kinds of cases.

He could have filed a civil suit against her and claim slander and possibly intentional infliction of emotional distress, but this takes years and a lot of energy. That and if she doesn't have much money to speak of, there's no point in suing. Also, pro bono lawyers typically only handle minor violations as far as I know. Correct me if I'm wrong, I'm still a lowly first year law student. :bunny:

A pro bono lawyer in his scenario would have been a public defender. A real private lawyer taking a pro bono case such as his would have been a god sent. Unfortunately not many lawyers will take a pro bono rape case.

any false rape or sexual assault cry should be given a double prison sentence compared to what the accused would have gotten if he had done it.

A teenage girl was locked up for six months today for crying rape - after she lied to stop her boyfriend finding out she'd cheated on him.

The 16-year-old girl made up the rape allegation after going home for sex with innocent Alex Lewis, 20, on a night out.

She lied to police that she was abducted, attacked and forced to perform a sex act during a violent assault by three men.

It led to Mr Lewis being arrested and held in custody for 36 hours. He spent two months on bail until the girl confessed it was all lies.

The girl, whose name cannot be revealed for legal reasons, admitted she was worried her boyfriend would be furious at finding she had sex with another man.

Her lies unravelled when she was caught on CCTV drunkenly kissing and fondling Mr Lewis on the night out.

A judge yesterday ordered the girl should not be named - even though three innocent men she accused of rape were identified in court.

The trio, all aged 20, were arrested, quizzed and forced to give ‘intimate’ samples during their ‘terrifying’ ordeal after the girl's false claims.

Prosecutor David Pugh said: ‘She said she was pushed up a metal ladder to an attic bedroom by two men, one of whom held her down.

‘She said both kissed her all over her body and was raped by one of the men.’

But the girl's lies were uncovered when detectives viewed footage of her picking up the group in Merthyr Tydfil town centre in South Wales and kissing one of the men, Alex, before they jumped in a taxi together.

Mr Pugh added: ‘Images showed they became very close, with the girl kissing Mr Lewis and placing her head on his shoulder and getting in a taxi.’

They returned to Alex's parents' house and had consensual sex before the girl left and flagged down a police car, claiming she had been raped.

The girl was arrested and admitted making up the claims in June this year.

I had a friend of mine spend a year in jail awaiting trial for rape. He was with a girl who was going down on him, and her grandfather caught them. She swore that he was forcing her to do it, and that he had raped her repeatedly. Unfortunately, it was not admissible in court that he was the sixth person she had accused falsely of rape in under two years. The charges were dropped, but that year in jail messed him up for life. What did she get? Nothing. I would have loved to see her lying ass spend time for every 'rape' she cried.

 

I was actually shocked to see you could go to jail for falsely accusing someone. Lawsuits are pointless because the perpetrators don't pay.

 

I'd like to see tougher sentences for pedophiles. They make my blood boil. I hate how they coddle them in prison. Look if hispanic gangs think murdering a molester is a good initiation rite... :) Why do we protect them?

LOL. dude, are you serious? I'm guessing you've never had sex then? If some guy asked to film me or have me sign a contract before we had sex I would bail in a blink of an eye.

 

I don't mean a recording as in a film, I mean a recording as in a voice recording where she states that she is a willing participant. This thread has freaked me out, even if I had a girlfriend I'd still make her do a voice recording every time if we are gonna do it. You think I'm gonna take the risk of ruining my life like all the examples in this thread?

Some of the stories here are just terrible, especially yours AverageJoe. I am sure I have heard of something similar where a guy was saved because he clandestinely taped his sex sessions. So it seems like false accusation of rape is not a crime in the US. wow. I remember reading a case were a guy in the US got falsely accused of rape and the charges eventually dropped, however he had subsequently been put on the sex offender database, and could not get his name removed. Just being charged is enough to get you on it...for f**ing life. Can anyone confirm if this is true. Its a travesty of justice if it is.

I doubt there's a specific crime of "falsely accusing someone of rape" in any jurisdiction. In the UK, and I'm sure the same is true of the US, a false allegation would be classed as perverting the course of justice.

 

With regard to rape, a woman making up a story about rape due to some personal agenda, as the girl whose case is being discussed here did, would amount to perverting the course of justice. Equally, however, someone who retracted a genuine allegation of rape would be found guilty of perverting the course of justice. A common reason for someone doing this might be that they fear reprisals if they don't retract the allegations. An example in the following link:

That is a shocking case. It stands to reason that women will, at times, be scared off into retracting their statements, and such a woman should not be punished, under those extreme circumstances because the claims aren't false, they are just being retracted.

 

Falsely accusing someone of rape is terrible, and holds devastating consequences for those accused of it. Their reputation gets shot to hell, etc. It also makes genuine rape victims suffer the fate of not being believed.

I friend of mine got accused of rape once. She screamed up and down he took complete advantage of her, she was raped! She made the accusation (just the accusation) and the company he worked for fired him for liability reasons.

 

Now, I knew this guy pretty damn well. I didnt think he was capable of it and her lawyers did a pretty good job of throwing some doubt into the mix and for a short time I started to question things. After some careful thought, and the time I spent with him and who he was, I had no doubt he did no such act. I stood behind him completely.

 

He on the other hand, had no recourse other than a lawyer. All he could really do is defend himself of the accusation. The accusation! How do you defend yourself from the accusation of rape? He was completely torn apart as a human being. The family, the friends were all really torn up about everything. He was raked across the coals in the media.

 

During the time in question of the alleged rape, he shared a home with a roommate. It turns out his roommate was a complete pervert. He had set up a camera in my friends room to video tape any illicit acts to get his jollys off later. Guess what? That video tape proved his innocents in a court of law. It clearly showed she was an able and willing participant. All charges were dropped and the case was dismissed.

 

He still had to pull his life together after all of that. People only want to hear what they want to hear and he suffered prosecution of public opinion for a very long time after that.

 

She said she was upset because he didnt want to be exclusive with her. And thought he might be interested in one of her friends. So, she thought she would show him.

Well, she did without any reproach.

 

I see her from time to time, she works at CVS and goes right along with her life.

 

Just the accusation boys, that is all it takes.

 

What's her name and location? Surely you shouldn't hesitate to 'out' her as a cry-wolf rape fraudster.

Rough to go back on. I think about it with anger, I admit that.

 

My friend has been putting his life back together since then, slowly. The ridicule sometimes still exists. Although, much more tolerable.

 

Have I thought of malicious ways to get at her? Yeah, I have. I have never acted on them simply because I hope what comes around, goes around.

 

I think a bit of word has gone around (this is a big city) and just in the community it may have follower'd her somewhat. I cant really say.

 

I really dont know what to feel about it anymore. It sure opened my eyes.
