UK jails people for False Date Rape claims? Why not U.S. too?

A teenage girl was locked up for six months today for crying rape - after she lied to stop her boyfriend finding out she'd cheated on him.

The 16-year-old girl made up the rape allegation after going home for sex with innocent Alex Lewis, 20, on a night out.

She lied to police that she was abducted, attacked and forced to perform a sex act during a violent assault by three men.

It led to Mr Lewis being arrested and held in custody for 36 hours. He spent two months on bail until the girl confessed it was all lies.

The girl, whose name cannot be revealed for legal reasons, admitted she was worried her boyfriend would be furious at finding she had sex with another man.

Her lies unravelled when she was caught on CCTV drunkenly kissing and fondling Mr Lewis on the night out.

A judge yesterday ordered the girl should not be named - even though three innocent men she accused of rape were identified in court.

The trio, all aged 20, were arrested, quizzed and forced to give ‘intimate’ samples during their ‘terrifying’ ordeal after the girl's false claims.

Prosecutor David Pugh said: ‘She said she was pushed up a metal ladder to an attic bedroom by two men, one of whom held her down.

‘She said both kissed her all over her body and was raped by one of the men.’

But the girl's lies were uncovered when detectives viewed footage of her picking up the group in Merthyr Tydfil town centre in South Wales and kissing one of the men, Alex, before they jumped in a taxi together.

Mr Pugh added: ‘Images showed they became very close, with the girl kissing Mr Lewis and placing her head on his shoulder and getting in a taxi.’

They returned to Alex's parents' house and had consensual sex before the girl left and flagged down a police car, claiming she had been raped.

The girl was arrested and admitted making up the claims in June this year.

Should be punished around the world with more jailtime than the average rapist gets. Just reading this makes me angry.

Who says false accusations aren't against the law in the US? They are. By the way in the US it would be a state crime, not federal.

What... I've never heard of this being prosecuted in the U.S, even really famous cases like the Duke incident.

 

If it IS against the law... why don't they enforce it?

 

Also... Why do they arrest the guy... THEN investigate. Shouldn't they do things the other way around?

LAS CRUCES, N.M. (AP) - Police say a Las Cruces woman has been arrested for falsely claiming that she had been sexually assaulted.

 

Police say 20-year-old Michelle Holcomb is charged with one count of filing a false police report. She's jailed at the Dona Ana County Detention Center on $1,000 bond.

Women who make false rape claims should be in prison for as long as actual rapists. Atleast several years. Women don't know what it can do to a man to be falseley accused of rape...

 

It is ALOT worse to get falsely accused of rape than it is for a woman to actually get raped. The man get's his whole life destroyed, friends and family will abandon him and if convicted will spend a lenghy sentence behind bars for something he didn't do, go down on a sex offenders list and etc etc.

 

It's exactly because of cases like that, why I would never have sex with a woman unless she does a recording on a cell phone or whatever where she states that she is willing to do it or sign a contract that she agrees to have sex.

Im pretty sure they are jailing her just to scare other girls from doing the same. They probably wont jail anyone else. Plus, if they did this in the US, theres quite a few womens groups that would cause a stir.

 

Every time somebody makes a false allegation of rape, the public has less confidence in the truth of other complaints of sexual abuse made by genuine victims.

 

She should have gotten a year for thinking they wouldnt question her.

LOL. dude, are you serious? I'm guessing you've never had sex then? If some guy asked to film me or have me sign a contract before we had sex I would bail in a blink of an eye.

Check out this blog for some anecdotes about reasonable scenarios and protections, as well as links to legal and media resources on the topic of false rape. The MO of the girl in the OP is contained within the scenarios listed there. I think you can find some reasonable middle ground, though it pretty much precludes anonymous, random sex.

 

I'm not familiar with UK statute but a 16 yo would be considered a minor here in Cali and subject to different statutes and punishments than an adult. A lot of kids here think they're invincible. So, apparently, does the sheriff. Man, how times have changed.

 

Hope she learned a lesson. Somehow, I doubt it.

I friend of mine got accused of rape once. She screamed up and down he took complete advantage of her, she was raped! She made the accusation (just the accusation) and the company he worked for fired him for liability reasons.

 

Now, I knew this guy pretty damn well. I didnt think he was capable of it and her lawyers did a pretty good job of throwing some doubt into the mix and for a short time I started to question things. After some careful thought, and the time I spent with him and who he was, I had no doubt he did no such act. I stood behind him completely.

 

He on the other hand, had no recourse other than a lawyer. All he could really do is defend himself of the accusation. The accusation! How do you defend yourself from the accusation of rape? He was completely torn apart as a human being. The family, the friends were all really torn up about everything. He was raked across the coals in the media.

 

During the time in question of the alleged rape, he shared a home with a roommate. It turns out his roommate was a complete pervert. He had set up a camera in my friends room to video tape any illicit acts to get his jollys off later. Guess what? That video tape proved his innocents in a court of law. It clearly showed she was an able and willing participant. All charges were dropped and the case was dismissed.

 

He still had to pull his life together after all of that. People only want to hear what they want to hear and he suffered prosecution of public opinion for a very long time after that.

 

She said she was upset because he didnt want to be exclusive with her. And thought he might be interested in one of her friends. So, she thought she would show him.

Well, she did without any reproach.

 

I see her from time to time, she works at CVS and goes right along with her life.

 

Just the accusation boys, that is all it takes.

I had a friend of mine spend a year in jail awaiting trial for rape. He was with a girl who was going down on him, and her grandfather caught them. She swore that he was forcing her to do it, and that he had raped her repeatedly. Unfortunately, it was not admissible in court that he was the sixth person she had accused falsely of rape in under two years. The charges were dropped, but that year in jail messed him up for life. What did she get? Nothing. I would have loved to see her lying ass spend time for every 'rape' she cried.

This makes me so mad!! How can somebody be so selfish. :mad: He should've sued the b*tch for defamation. On the upside, thank goodness his roommate was a pervert.

I'm surprised it's taken this long for the inevitable female poster to talk about how false rape accusations are exceedingly rare and that the only true standard for whether or not a rape occurred is if the woman considered it rape. :rolleyes:

It's interesting that male rapists and pedophiles often get 'special' attention in prison from the inmates there. Too bad some of the false rape accusers couldn't get similar special attention. Nothing like a little show of what rape really is about to help them get their priorities straight.

 

BTW, anyone remember the Tawana Brawley case?

It's a really tough situation. Actual rapists should get the death penalty. False accusers should be thrown in prison for quite a long time.

 

Hard to differentiate between them, though.

:confused: why would say something like that? This is just ASKING for a stir. :mad: No female said anything and I doubt they would have. Accusing someone of rape is just as bad as rape itself.
