I am getting a divorce in Maine, where it's a no fault state. My lawyer is out of town for a little while, and I'm worried about finances. I filled out the financial info, and he did too.. he "stretched" the truth on quite a number of items. Per hour, we make about the same. All he's doing is helping with 40% of the mortgage. He says he can't afford to help out because he's paying the 40% and his rent. I wanna call b.s. on this... but my question is... winter is coming soon, and oil bill is extremely high.. I cannot come up with any extra money to pay for oil or any other out of pocket expense. Putting all my bills together, our bills total 3k a month, and I make 2k a month, He makes 1.3k a month, but he only gives 480 a month (he says he pays 250 a month on rent, but living with girlfriend). I'm worried that he will stretch the truth (lie) to the point where he will get out of helping any more (he already did on paperwork). Will the judge ( I know no one can predict what a judge will do.. but I would still love an opinion) see how much we have in bills and make him help out more, or will I be screwed because of his tall tales?

 

I know this post is long, but I've been stressing about this. I make too much for help through the state.

Generally when emotions run high, it's hard to see both sides of the coin.

 

So, I think you should wait until your attorney returns, and seek additional guidance on the matter.

Judges realize, expect, and understand that non custodial parents will fudge their finance reports to make it seems as though their expenses are so high they cannot pay the child support required.

 

In general, their expenses are not taken into account as much as the children's and parent charged with their living expenses.

 

That being said...you may have to make some changes yourself. If keeping the house makes you unable to afford to heat and eat, etc...the judge will not feel that is the responsibility of your ex.

I can understand if we were divorced, but in Maine it can take up to year to have the divorce finalized. We just started a month ago.. so, the divorce can take forever. I understand after the divorce, I'm going to have to move. We just bought the house back last November, so there's not much equity. But, in the meantime, I feel so screwed. I can't move, because we have the home..
