Any idea out there as to how long it takes to get to the final stages of divorce? Thanks to the new emergency budget my cetv pension (and his) cannot be calculated as there is a suspension on all divorce pensions until further notice.

At the slow rate the divorce is progressing I suspect that by the time we get to court either one(or both of us) will be dead from old age!:laugh:

Depends on where you live and whether you both want to work together. In my state a divorce without children can be as quick as 60 days if both parties agree on everything. On the other hand I've had friends take 3+ years (and lots of $$) to get divorced when the other party didn't want to cooperate.

Mine has been going on since january, He wanted it, I never tried to stop it, but he is dragging his feet, hopefully oct 6 is our pre trial something will happen then, mine is a little complicated because my stbx thinks the laws should be in his favor, he claims he cant pay child support, and alimony, he hasnt turned over the papers that we were asking for, his own lawyer told mine she was having a hard time getting things from him. His family is ruthless. He went so far as to say his own lawyer dont know what she is doing shes an *******, nice huh. hes very arrogant, I was talking to my lawyer and she said he is nuts if he thinks his lawyer is gonna break laws for him, she has to go by the law herself. we will see in october. I just want it over now, I can count on one hand how many times i have even called him and he calls constantly, and was told by his own lawyer to stop, he dont listen, I hope the things he is doing in the meantime to me busting my balls when I have been nothing but cooperative, comes back to bite him in the ass.

 

 

 

 

 

I assume he is trying to weaken me so I just give in to what he wants, I was always controlled by him and would do anything he wanted, 20 yrs of it. I really suprised myself by being strong and not doing the things he wanted me to do. He really thought i would lay down and die, his aunt told me he thought I was gonna be like his mom when she went through her divorce because stbx only seen how she was and she was depressed over 2 yrs crying all the time couldnt get out of bed. suprise!! I am nothing like you mother. his dad also thought I would cave, they all thought I was gullable. So I am hoping by christmas at least, something will be done.

Granting your Decree Absolute has nothing whatsoever to do with this financial matter, and will not affect the divorce.

 

it is advisable to get all the division of assets, goods, chatters and joint property out of the way first, but this isn't always possible or workable, and many divorces go through with some financial matters still unresolved. Mine did just that.

A Decree Absolute is granted 6 weeks after the Decree Nisi is issued, providing neither party enters any objections to the divorce itself, or the conditions therein.

 

I don't know who has suspended calculations on your pension... is it the issuer? the court?

You need to ask a financial adviser, but providing you have activated division, and distribution of pensions, this will happen. but it's got nothing to do with the progress of the divorce.

Apparently the new Govt has decided to suspend all cetv pensions (teaching) and has not given a time scale as to when the provider can calculate each party's share of the combined pensions.

This has to be calculated before the financial assets (ha!ha! :rolleyes:) are divided in the divorce settlement. And there are contested debts.

As both of us are on legal aid I can't see it being settled any time soon-and just wondered if anyone else is having similar problems?

Although technically my STBXH has accepted visitation rights to our daughter, he has shown no interest in seeing her and she doesn't want to see him so unless he has a massive change of heart (doubtful!) I don't think he will bother about his daughter,so its just a massive waiting game.(sigh).
