Dad_of_2_great_boys Posted August 25, 2010 Posted August 25, 2010 If you don't know my other posts, quick summary: My wife had at least two affairs. She admitted one. I requested she stop and work on us for the kids, but after she lied and resumed affair . My only option (personal choice) is divorce but I want custody of our two sons (11 & 6). I have filed but wife has not yet been served. Tonight: I am playing with the eldest and he is trying to test his strength with me. We are fooling around. Wrestling. I swing around and inadvertently end up twisting his head. I immediately go limp when I hear his pain. I run and tell the wife I am taking him to Urgent Care to have him checked out. Wife follows behind in her car about 5 minutes later with our youngest son. Everything turns out fine. Doctor evaluation is a muscle pull. Stiffness and pain in neck is already subsiding. No XRAYs neccessary. They give my son one Motrin and send us home. Now I sit worrying how this will get spun when the legal battle starts. Am I worrying about nothing? Anyone else do (or felt like they did) something stupid to mess up their case?

Just make sure you and your son are both ok with each other after this. Don't worry about it being spun into something else. Fathers and sons have been wrestling I'm sure since the beginning of time. Playing with your son is no crime, and accidents do happen to everyone.

Just make sure you and your son are both ok with each other after this. Don't worry about it being spun into something else. Fathers and sons have been wrestling I'm sure since the beginning of time. Playing with your son is no crime, and accidents do happen to everyone. He is fine and he's already pushing for round two....

I am sure your son will testify in open court that you two were simply wrestling and this wasn't in any way shape or form abuse. But lawyers get paid to "spin" facts. So be on your toes for that possibility from your wife's lawyer. Also inform your lawyer that this happened so he/she will have a counter argument just in case. Best of luck.

Did the Doctors document what happened and what you told them? You can get a copy of the info and have that in your back pocket just in case, so you have the facts to set any crooked Lawyers straight!

The TRIAGE nurse seemed joking when she said something like "and you admit you did that to your own child......" Time to check the file.

Judges and family/children advocates KNOW that accidents happen. Even if your wife tries to spin it like "negligence" (or whatever label(s) you are most fearing), there will be intelligent, objective individuals looking at the 'evidence' and making up their own minds. You didn't do anything "stupid" -- unless it is "stupid" to play with one's kids Biggest thing here is for YOU to let this one go...and not carry it around as if you are some "stupid" dad who is "guilty" of...whatever label(s) you are most fearing. All of that crap only happened in your head. In reality, you were a loving dad, playing lovingly with his kid. This is a fact for parents: Your kids are gonna get hurt -- at home, in the playground, in church, playing with other kids, playing with adults -- because accidents happen, and kids are sometimes clumsy and sometimes just don't know when/where/how to be careful.
