cookie2 Posted July 23, 2010 Posted July 23, 2010 Hi, Divorce law in the UK says that you have to be married for a year. But I have been married 9 months and just discovered my wife's affair. What would be the best course of action? I've already sorted out the finances and we don't have any kids so all is good on that front. Can the divorce proceedings be started now, since they probably wouldn't be finalized until the year is up anyway? Or does it need to be a full year before the proceedings even begin? If I can't start until the year is up, can I still use the 3-month-old affair as grounds? I'll probably talk to a solicitor today anyway, just wondering if anyone knows.

You should really speak to a divorce lawyer to check out your options but I'm pretty sure, if your wife has had an affair you can file straight away. If the one year rule does apply then I do know that, if she stops the affair, and you continue to live with her for a further 6 months after you found out, then you can't file on the grounds of adultery. If she is continuing the affair, or if you move out straight away, you can file whenever you like - or at the 12 month mark if that applies. Good luck.
Author cookie2 Posted July 23, 2010 Author Posted July 23, 2010 Just seen a solicitor. She said that unfortunately I can't do anything until the 1 year is up. But if I go see them after 11 months they can start the paperwork and process, so that it can go ahead ASAP. We're definitely not going to live together after this, and I'm not going anywhere - she can get the hell out my house!
