I need some answers about South Carolina Divorce law.

You should probably talk to a lawyer licensed in South Carolina. Using advice off some internet forum to base decisions on something as serious as divorce is a recipe for disaster.

My best friend is going through a D in SC. Two things I can tell you for a fact are:

 

1) there is no " no fault" divorce, so you will either have to be seperated for a year, or file for cause.

 

 

2) it's more expensive there than a lot of places. He paid around 8 k and she paid around 10K and they were only fighting over a condo.

 

 

Do the year seperation if you can.

My husband has filed a 'fault' divorce against me on the grounds of adultery (3 months).

Im not from SC, but I'm sure we have some members here that are. Maybe just put your questions out there and see who has an opinion. So long as you remember that they are just that. Opinion and not true legal advice.

Are you still residing in SC? I had a heck of a time because I moved from SC to NC...spent a year in limbo before I could even hire a lawyer due to residency.

 

My advice, if you own property together, do not move out of the property...If the laws haven't changed in the past 20 years, even common-law marriage is recognized in SC.

 

You need to see a lawyer in SC asap.
