sellyguy Posted May 3, 2010 Posted May 3, 2010 I just started dating this girl for about 2 weeks who has been dealing with a pretty rough situation. She just educated me on the whole scenario and asked what she can do, but i dont know and thats why im gonna ask others as well before we spend money on an attorney. She had left this guy tony about a year ago due to drugs and just being a slob. In that years time, he has been been trying to prove hisself a worthy father but he isnt doing a good job at it. The goal she is trying to accomplish is, getting a situation under controll without taking his son from him or sending him to jail but if it were up to me i would just call the damn cops. Heres the situation: He gets adam ( the child) through out the week and every other weekend. Everytime she goes to pick him up, She finds that tony keeps putting adam to sleep in a room with black mold, moldy blankets, moldy mattress, and moldy pillows. Obviously, antone who knows about black mold right now is probably pretty outraged at the thought of this. She has also found stuff in his house to make her think he is still using drugs but i dont know what kind. It doesnt really matter, a drug is a drug and shouldnt be in the same house hold as a 2 year old child. She has warned him several times to stop doin this to adam but he wont. Apparently he is a pretty powerful individual in there town and she is teriified to call the cops or take it to court because of what he could do or something coming back to bite her in the ass. Also she doesnt want to take adam away from him because adam really enjoys spending time with his father. Is there anything that can be done to get this resolved without causing harm to leah (my girl) adam (child), or Tony(father). She also told me that his family is pretty close to her and she doesnt want to do anything to hurt them as well. If you have any ideas, please let me know. thanks!
sally4sara Posted May 3, 2010 Posted May 3, 2010 What kind of power can this guy have if he can't afford better bedding for a two year old? Do you really thing someone how can't even secure clean bedding for their kid has the kind of power it would take to sway a judge? Something about this story doesn't add up. If she lives away from him, and they have a courthouse in the town she lives in - she lives there for 6 months, she can file in the town she lives in for the custody proceedings.
2sure Posted May 3, 2010 Posted May 3, 2010 Fair or not, it is unusual for the father to get custody of such a young child. What are the mother's circumstance that she was not awarded custody of her son?? The living conditions, while certainly neglectful, are not illegal. Calling the cops and telling them he is using drugs....will not do a thing, it is not enough for a search warrant, what could they possibly do? Unless the mother has drastically changed her life style , living arrangements , and income - unless she has more stability and security to offer this child...the courts will not change anything. If both parents are unable to offer this child what he needs...he could go into foster care.
