300 lb woman sits on her 120 lb boyfriend and kills him

While it was VERY wrong of her to kill the guy and she SHOULD have gotten a stiffer sentence, apparently he WAS the one perpetrating violence against her in the past. The story originally posted said there had been a history of domestic violence, but it didn't say against whom. The above story indicates it was he being violent toward her. She'd just had enough.

 

She should have just kicked him out though. Sheesh! :rolleyes:

No lawyer would claim a long history of abuse if it was his/her client doing the abusing. :laugh:

 

And since there had been a "history" of DV, it would have been on record and VERY easy to dispute if it had been otherwise.

She should have been sentenced to 5 years of:

 

1) threadmill 8 hour a day

2) water and veggies only

Maybe, maybe not. Women get off crimes scot free every day by claiming abuse despite there being no court or police history whatsoever. My domestic law colleagues tell me some mind-blowing things.

 

Am -not- blaming this on women, but on society. Any defendant, regardless of gender, should use any tactic possible to get off or have a sentence reduced in light of the dishonest tactics of police and prosecutors these days.

There is the pragmatic imperative of a dead person telling no tales; in other words, being dead renders them unable to present an affirmative support for prosecution. This is the MO of the stereotypical 'black widow'. Life in the modern world :)

Is this for real? The details just don't add up. According to the story this was during a fight which shows motive, and suggests that she basically smothered him to death. I could understand if this was some sort of freak accident but it looks like she intended to harm him. WTF?

How many 120 lb women are with 300 lbs guys who are not professional althletes?

 

This story is wrong on so many levels, but it shows:

 

(1) no matter how overweight a woman is, she can get a guy

 

(2) You can murder a male, and not be punished for it.

 

(3) community service for deliberetely trying to at least injure or kill someone?

 

(4) If he had killed her, do you think he would get community service?

You guys have made all sorts of assumptions here.

 

Manslaughter, as far as I'm aware means, that you killed someone but it was not pre-meditated, if it was planned out it would make it murder.

 

Involuntary manslaughter, would therefore mean she didn't plan to murder him, nor did she on the spur of the moment decide to kill him. It basically means it was an accidental killing.

 

From this, guilty plea of involuntary manslaughter you are all saying that because she's a woman she got off for 'murdering' her husband?

 

Maybe they got in an argument and she launched herself at him, both fell on the floor and she sqaushed the air out of his body while she was fumbling to remove herself from him due to her large size. Maybe he was drunk and therefore didn't wriggle so much, who the hell knows.

 

Whoever said it, was right, that her legal team wouldn't mention the domestic abuse if it had come from her side. Because this was mentioned you are all assuming that she did this out of revenge, without knowing any of the ins and outs of what exactly happened which would have been presented and cross-questioned in court.

 

A jury was presented the evidence on this case and the result was given, and yet you guys have decided it was murder from reading a badly written article with sketchy details that was more concerned with reporting the kooky manner in which this man died and that she should be given the electric chair or something. Glad I'm not up in court for something, with you guys as the jury, you'd have me sent down for years because you'd have all made your minds up on what the situation was without hearing the evidence.

and if the jury had been presented with a male defendant who claimed previous abuse on the part of his wife, and that he "accidentally" crushed his wife -to death- in a fight, that there would be a snowball's chance in hell that he would EVER get off with mere probation and 100 hours of community service? or that the judge or DA would have even -allowed- a manslaughter plea before the jury? Odds are, in most states, he would be headed for life without the possibility of parole, and in some states, straight to death row. Tell me I'm exaggerrating.

I know, let's just dispense with the judicial system and bring back gladiatorial arenas where we can watch this guys genitals being cut off, fed to a dog, no, make that a tiger, while he watched his own demise on a massive screen. Then executed by a firing quad (not sure about this...too quick) to a cheering crowd (of women).

 

Be thankful you don't live in France. Wasn't there that law-changing case a few years back where a woman was acquitted for murdering her husband because she was getting her period and was therefore not in control of her behaviour?

She was convicted of involuntary manslaughter. The evidence is she admitted guilt, pretty cut and dry. The jury didn't decide anything, since she plead guilty. The judge gave the sentence, which is crazy. In my state the minimum sentence for involuntary manslaughter is well over 2 years in jail. I didn't even know there were states where you could get off with nothing.

The more I read this and look at her, the more I think she was hiding up on stairs, on a loft or some overlook in the house with a Mexican wrestling mask on and a cape waiting for him to walk under her.

I understand that the sentence was kind of strange (not strict enough).. but we have to admit that this whole story is kind of funny... probably the judge had problems keeping his 'seriousness'..

I do feel very sad for his family, the loss of their loved one is a joke to so many people :(
