canuckinchicago Posted November 14, 2009 Posted November 14, 2009 Hello folks! I am seeking a divorce from my wife. We have been married for 8 years, with 2 kids (6 year old and 19 month old). I will fulfill my obligation of paying child support/alimony. My question is we have been both living in Chicago with green cards, eligible for US citizenship in 2011. We are both Canadian citizens also. Will Child support payments be based on Illinois law or Ontario law? We got married overseas in India. I am bit confused on the matter, and I have not found a lawyer who can answer this. Would it better for me to file in Ontario or here in Illinois? She is planning on moving back to Toronto as well with the kids, I don't have a problem with this but I do want visitation rights. I own a condo (i am only on title and no equity - market is terrible), I finance 2 vehicles, 401k, pension, stocks, credit card debt. Since I was the sole earner in the family, everything is under my name, as she has hardly any credit due to no income. All advice would be appreciated. Thanks.
