Ok here is the situation.

I have been seperated from my husband for 4 yrs now and am living in a different state. We have 4 children together and he is not wanting to give me full custody of them even though he does not pay child suport or work to suport them, and we have a hard time financialy getting them back and forth.

What is the easiest and cheapest way to go about getting a divorce without a huge custody battle and court cost?

In all seriousness, what state were the children born in & raised in?

Your's or his?

 

I don't think you can move out of the home state & take the children with you.

 

It's frowned upon in NYS & almost impossible if one party doesn't agree.

Plus, child support cannot be enforced on a NYS resident if the children are taken out of state.

 

At least that is how I understood it when my friend's ex tried to move out of state with his daughter.

 

I don't see how you can do anything without any court visit.

Well heres the thing. He left the state first (Arkansas) this is where the kids were born and raised. After He left I went to live in Texas with a friend to help me out financialy.

He was ok with me leaving the state but wants half custody. He is not a good father at all. He was phisically and emotionally abusive and did not work to suporrt his family for the 10 yrs we were together.

Now he is back in Arkansas living with his sister, still not working and has a felony on his record sence I left.

He now has a baby by another woman and is not supporting it either.

I think he is just doing all of this to be spitefull to me.

He don't care about the kids at all. He dosen't even call them.

I highly reccomend getting with your states legal aid program...get a free consult with a family lawyer.
