Is common sense returning to England's divorce laws?

Maybe, must maybe, common sense might be returning to the the English divorce system.

 

Lady Deech, chair of the Bar Standards Board which regulates lawyers in England, suggests that an automatic 50-50 property split in divorce judgements is unfair to the party that brings substantial assets into the marriage.

Lady Deech says settlements that automatically keep ex-wives in comfort at the expense of ex-husbands are wrong

 

"Trot down the road to the law courts and there you'll find a woman with maybe no particular qualifications, married for a short time to a celebrity of some sort, will walk away with many, many millions", Lady Deech says...

 

"The message that's going out is marry a footballer, marry a banker, stick it out for a few years and your lifestyle will always be on that level", she says.

Is this, finally, a return to common sense?

Perhaps the 50/50 split is too stringent, although I'm not entirely familiar with divorce laws.

 

I think each couple and each divorce is so individual, but the courts just don't have time to sort everything out, hence the rather black and white rules.

 

From what I understand though, some assets acquired before marriage do not get included in the 50/50 split, for example, a non-marital home owned by one of the spouses. But the laws likely vary.

Like my friend, married in college, she gave up on her MA to support and raise their three kids, while she put him through med school. Only to be dumped on at age 30 for the young secretary. She was nice, only got 40% for life. She went back to school, got her law degree, now makes more than him plus the 40%.

 

Or my GF, gave up on college, married a military man, who decided to re-enlist, not her idea, raised their two kids, in places like Minot, ND, Riverside, CA, Omaha NB, he turned alcoholic and abusive, finally threated the kids with a knife, she moved out, had to work 2 and sometime 3 jobs, to support the kids, could not afford a divorce attorney, just to get rid of him signed the papers, her reward after 20 years, $250 a month for each kid, or $500 alimony after the kids became of age. His reward monthly pension check nearing $4000 a month.

 

The whole thing assumes, that a young woman, only married a star athelete or banker for the money

I think it would be more common sensical if couples discussed this before marriage and signed some sort of agreement. That's what I did when my ex and I bought a property with money inherited from my grand dad.

 

@ 2.50 gallon - $250 per month for each kid is a lot of money! I get about $150, and I get more than some single parents I know. I don't think you get any more for time served ;)
