Vlad Posted September 11, 2009 Posted September 11, 2009 It seems she didn’t jump the border with her parents, did she? If she didn’t then she most have a passport cause she need one to get to the Us. How old was she when she arrived to the Us, you know? If they did jump the border with her, still that girl has to have a birth certificate, even the indigenes in Mexico that are people that don’t even speak Spanish and live in the most rural areas ever know to man have a birth certificate it’s almost impossible not to have one now believe me. Tell her to find it has to be somewhere in the house hiding somewhere, maybe she can even find her passport so when she is 18 she can come back here and start all the legal stuff you being advise about.

If she didn’t then she most have a passport cause she need one to get to the Us. It appears she didn't "jump" but was carried over the border illegally by her parents. She doesn't have a passport. And can't have a passport as of now because her birth is undocumented. For all rights and purposes she does not exist officially and is without country. Her passport isn't being hidden and it is not almost impossible not to have one. Plenty of people don't have passports. My brother didn't have one until he was 42 and traveled to another country for my wedding. He did have a birth certificate so he could apply for one but she does not have that either. Her birth is undocumented. It happened on a beach somewhere in Mexico and went unreported. Unfortunately that is quite easy to do as well although most parents would not subject their children to the terrible circumstance she now finds herself in.
Author joncolon4 Posted September 29, 2009 Author Posted September 29, 2009 Hey all I'm so sorry I havn't been posting! My dad kinda beat me up really bad so now I'm in foster care. But yea thanks for everyones input! Her mom has actually been talking to a lawyer apparantly and is working on some way to get her daughter legal. We're still very much in love its been about half a year since we started and its as strong as ever I'm starting to think it'll all workout for her. Her grades are eceptional and we're actually seeing each other more now, even though I now live in the next city about a hour drive away.

I'm glad you have been able to see her more often and lean on her for support during this time. Just take care of yourself. Everything will work itself out.
Author joncolon4 Posted September 29, 2009 Author Posted September 29, 2009 Its cool. At least I'm safe from my father for now. I don't think I'm ever going back home. But anyways... I have a question. If her American born sister turns 21 she can't fix her family up with papers?

If her American born sister turns 21 she can't fix her family up with papers? She has to be able to sponsor them -- the income qualifier -- and she could not sponsor all at one time. Your girlfriend will absolutely need to provide a birth certificate with the original filing. That is why I said it is the first step and is crucial. THAT has to be figured out. The sister will have to apply for them and I don't think she can sponsor all of them at once but a search of immigration information should clarify even if it takes a little doing. Or a lawyer can tell you right away. I'm glad you are safe jon.
Author joncolon4 Posted September 30, 2009 Author Posted September 30, 2009 Thanxx really I'm ok now though. No biggie. I mean yea it is a biggie but not now anyways hahaha. So what if they just get her a birth certificate and put on it that she was born in the US?
