Should I sue her for the loans I granted her, she has left me

She has left me claiming high stress with her teaching job and her evening college classes and does not have time to see me, but is dating an other.

I have the paperwork to file a small claims sue for $3200 which I loaned her to pay her past due real estate taxes and save her home. Should I file.

Yep, I would.

 

But, you only have a case if she signed something saying it was a loan and she agreed to pay it back. Otherwise, she will argue it was a gift.

I concur with JB. Yes, you should. She clearly used you and your resources, got what she wanted and is now setting up another fellow for the same thing.

 

Bear in mind that if you don't have a written re-payment agreement, it may be tough to win. The burden of proof is on you. But by all means, file. Just filing on its own might be enough to get her to cough up your money.

He said she was a teacher and she's dating another, it probably really is the principal!

 

Just kidding, anyway if it was agreed it would be paid back then I would first speak to her and see if she has any intentions of working out a payment schedule prior to having to sue her. If she is wishy washy or flat out denies to work it out, and it was always agreed this was a LOAN and not just something you did to help her out during the course of a romantic relationship, then yes I think you're entitled to get your money back.

Yes. I would sue. I would ask for the money first though, you should probably do this by certified mail. Even if you don't have a note, a verbal agreement is usually binding and it only costs like $65 dollars to file a small claims suit. Make sure you have receipts. Do you have any emails or anything like that? That will probably be enough to win
