Are most people technically sex offenders then according to law? Apples ≠ Oranges, my friend. You're talking about a girl that is underage losing it to a man FIVE YEARS OLDER than her. What is most common is kids having sex with kids. I'm not saying your situation doesn't happen - it does. But it's illegal. In Colorado, a person at least 15 years and up can have sex with a person less than 4 years older than them and it's still legal. So, if we took your GF's age (17) and added 3 years to it, the Colorado lawmakers have decided that a 20-year old could have sex with your girlfriend and there's no problem. It depends on your state. As far as I know, in the majority of states, if one person is UNDER 18 and one is OVER, the person that is OVER is going to jail. It's called being an adult and you should know better than to be having sex with minors.

But I mean, age shouldn't matter though if you're past consent age though, yes, no matter the age difference? Like in a state where the age of consent is X years, that means if both people are >= X years old, it's legal, correct?

There would be no issue then, now would there? Where are the girls parents on all of this? Are they okay with you dating their daughter? See, usually a pissed off family member gets the ball rolling, unless it's something obvious like the girl has a kid by an older guy. Then it's kinda obvious he banged her. LOL Also, make sure she (your girlfriend) does not get mad at you. Because she could just turn you in herself for having slept with her. Trust me, i've seen it done. LOL And it doesnt matter that she consented..because....why? She CANT consent by LAW if she is underage! Good luck, and be careful. If you really care for her, and also care about keeping yourself and your future safe, just hold off until she is 18.
