mendsley Posted May 1, 2009 Posted May 1, 2009 When my STBX seperated, about 9 months ago, she moves away from me to another state, California, and signed up for Welfare from the County. Someone today said that during the divorce the county will probably come after me to pay some of what they were giving her the past 9 months. Is this true? I mean she left me! I don't live in California! If it matters we have one child between us. She has a total of three children each having a different father. So if they come after me they better go after the other fathers as well. We planned on filing on California, but would that change things if we filed in Utah, where I live?
delajoonal Posted May 2, 2009 Posted May 2, 2009 YEP! california does NOT waste time trying to recoup monies from welfare people...years and years ago, i had a friend who had 3 kids from 3 different men...during this time of having ALL these children, she was on welfare...long story short, the state went after ALL 3 men to collect on the welfare checks she had been recieving for years.... also, if you don't pay, they will put a lien on your pay check, or even your bank account... listen to this, one of the fathers, NEVER worked on the books, always under the table, so by the time HIS child(boy) was in his teens, this man finally had a job on the books (legitmate), he was remarried, etc... well, all these years later, they (the state of california) came after him and took in the first lump 5000 dollars...ouch!... he owed something like 22K by this time... so, long story even longer, YES, they will come after you...so if i were you, i would set up something with your XW...it would be cheaper to pay her child support and alimony on your OWN, then have the state come after you...btb, it doesn't matter what stater YOU ARE IN...it matters SHE is collecing and living in california. good luck guy! take care..

delajoonal Posted May 2, 2009 Posted May 2, 2009 oh that is perfect, SO GLAD you did that...cause when the state comes after you, you will have proof of those payments...here is the BIG question.. is your W claiming those child support payments? you know, when collecting any monies from the state, be it welfare or disability, you have to claim ANY and ALL extra monies recieved... so BIG YIKES! if SHE is not claiming the money you are paying her now... SHE will have to pay back the state NOT YOU..if that is the case?

I have kept a record of every payment I deposited into her bank account? Guess what? in a lot of states if you didn't make those payments to the state's depart of Revenue they don't count. In some cases a judge will rule that you have paid..but only if you have evidence ie: cancelled checks made out to the child's mother with the words "Child support" written in the memo area. Those deposits you've made to her ? she can claim that you've been repaying money you owed her or any other such thing. Also,each state has a forumula that they use to calculate child support which is based on the non-custodial parent's income. You may have been paying but not paying according to guidelines for CA. You need to lawyer up and quickly, even if CA goes after the father's of the other children it will not lessen the amount you are required to pay. The goal of the state will be to get enough in child support orders from all involved father's to remove your ex and the kids from the welfare rolls and to recoup the monies the state has already spent, including medicaid/food stamp costs.
