climbergirl Posted February 11, 2009 Posted February 11, 2009 Along the lines of the engagement ring thread...I'd like to know your opinion on this... My stbex husband feels entitled to have my rings and the papers that go along with them. He says he should have them and is under no obligation to give me the papers as he bought those rings. I might add that he bought the engagement ring when we were married as the the first engagement was broken by him, ring given back to him and subsequently returned to the store by him. I agree that engagement rings should be given back regardless of who broke it off, but what about the wedding rings?
2sure Posted February 11, 2009 Posted February 11, 2009 It just so happens that I know a little about this. Engagement rings are given in anticipation of a "contract" of marriage - if the marriage doesnt happen they have to go back. This is why an engagement ring should not be given on a BDay or holiday - so that it could be construed as a gift. Once the marriage has taken place the rings belong to whoever wore them. The engagement ring and wedding ring you wore are yours. Unless a prenup specifically states that in the event of divorce - the rings are to go back to ...say ,the family they belonged to in the event you were given a heirloom. As to the papers...worthless, don't bother arguing over them. No jeweler , insurer or buyer is going to use them when appraising them - Especially if they are from the original seller.
Author climbergirl Posted February 11, 2009 Author Posted February 11, 2009 Nope, no prenup, nor are they heirlooms. He just thinks that since he gave them to me that he should get them back...probably since we were only married 6 months. I know he didn't ask his first ex for the rings back.
