Alan430 Posted February 3, 2009 Posted February 3, 2009 Hi me and the STBX has agreed on everything including property , custody and child support. At least for now!! My question is in regards to GA law for child support and uncontested Divorce. If we go though a mediator and agree that no child support is necessary will the courts over turn and make me still pay child support. I am not a dead beat and my STBX knows me well enough that she will not have to worry about this matter when dealing with my son. I agreed to cover insurance, medical bills, and other related money issues in regards to my son. Also i will cover all his expensive when he is with me 50% of the time of course. I am more then happy to do this. i make about 2x her salary now. However i am stuck with all the bills, debt (Only around 2k not including mortgage) and a new house which has a pretty hefty mortgage. Does anyone have any information or expereinces they can share with me?
2sure Posted February 3, 2009 Posted February 3, 2009 The state does not step into child support matters unless: She takes you to court regarding it You take her to court regarding it The child or parent receives state aid of any kind , like medical, food stamps, or child care assistance. The state does not automatically look at your child support arrangement simply because you file divorce. Note however that she can take you back to court for child support at any time - I think some states have a 2 year minimum between orders. The child support is separate from debt, mortgage, etc. and your responsibility and/or payment of those would not be considered in factoring it.
