unbreakable99 Posted January 24, 2009 Posted January 24, 2009 I've been lucking for a bit, well here goes me an my husband had been together 7 years when he decided one day he just doesn't love me anymore, well i have 4 kids, wonderful kids 1 to him an 3 from previous relationship. We own a house together since he walked out he has not payed mortgage i have, i work 70 to 80 hours per week to do this an pay everything, childcare, rates bills, credit cards he has payed nothing. I'm in the middle of taking him through child support, but the thing is through it all i cant seen to hate him 4 what he has done he turned up a week ago and showed me this video of me he still has in his phone. I mean wtf is this all about? I just want to keep the house and bring the kids up in a stable home. I have decided to have no more contact with him an let the lawyers sort it out as i think he is playing mind games, like on New Years eve he texted me to wish me happy new year, on xmas nite we kissed. I have not had sex with him since he left and will not. I've told him I'm not his booty call and do not contact me anymore. Well, I guess im asking do you think i have a chance of keeping the house? Kids are 12,9,6,and 4. Thanx in advance!
steveraves Posted January 24, 2009 Posted January 24, 2009 These types of questions I think are always best answered in a law forum. There's certainly a possibility you could keep the house. The court could award it to you or you may have to buy him out. Either way you'd probably have to refinance the mortgage in your name only.

This is a question you should ask your attorney. However, from what I have seen, IF you have a very good attorney the judge will favor giving you the house because of the children. You may end up paying him for some of the equity or just living there until the kids are grown. How much you pay him for the house and the method of payment would be subject to negotiation. Don't rely upon people on an Internet forum to conduct your divorce. A very good attorney will look out for you and get you the very best deal. Ask the courts to establish child support. Please seek legal advice. Every situation is different. We can only give you advice based on experience. What you need is concrete counsel.
Author unbreakable99 Posted April 7, 2009 Author Posted April 7, 2009 update... he came down last nite to see wee one as it is her birthday, having seen him in 3 mths, after we ended up kissing on christmas nite, i had to tell him to leave me alone, i still love him, but i have to heal, he signs house over next week removing all ownership, he is now bac home living as he did not keep up payments on his flat, im in process of child support but almost feel guilty about it, he says he misses kids so much.
mark982 Posted April 8, 2009 Posted April 8, 2009 he's blowing smoke up your rear end.there's no reason for him to be there. once house is in your name, toss the bum out.why all of a sudden he misses the kids? cause he aint got nowhere to live.
