My STBXH got a ticket for malicious mischief in the third degree, The morning after he told me he was having an affair, and wasn't going to stop. I had locked him out the night before because he wouldn't let me leave, and was getting physically abusive. He came back the next morning, and climbed in a unlocked window, and when he saw that I had packed up all his clothes from the dresser, and placed them on the porch he went balistic. He threw all the dresser drawers, and my clothes all over the room, and threw a very heavy stained glass lamp against the wall. I called the police. I told the policewoman that he hadn't physically attacked me, hence the malicious mischief ticket. He asked me to come to court with him and say it was all blown out of proportion. When he went to his first hearing the judge told him he needed an attorney, because of all his prior trouble (3 dui's, driving on suspended, no interlock device), and because he was still on probation, he was looking at a max of 1 year in jail, and a $5,000.00 fine. My attorney said most likely 30 to 60 days of home monitoring which is fine with me because he is living at the OW house right now. I told him I would go IF he signed a paper with specific dollar amounts, and bills he would pay until the final divorce decree. Nothing out of the ordinary, just what he pays now (I am 100% disabled, 10 years out of the 22+ we've been married). Well he didn't like that idea, said I was discounting our 22+ years together, he would always take care of me, don't I trust him? (Yeah, uh I DID). So, sorry so long. Would you go if he didn't sign the paper? Or let him swing?
