My husband and I agree its over. We both want a quick and easy divorce.

 

Neither of us have the time nor the energy to do the lawyer things, plus we've already agreed on everything.

 

Can any of you tell me some sites that prepare the documents for you? I've heard of them but don't even know where to start looking.

As long as you don't have kids it is relatively easy to do the divorce yourself what is called "prose". I don't have any state specific guidelines but you can always google prose divorce for your state. There is usually a filing fee around $150-$200. If you have more details I may be able to provide more info. Best of luck in getting the info you need

A paralegal is the cheapest and quickest way to go. A "Marital Separation Agreement" equivalent to a Divorce Decree detailing who gets what can easily obtained online or at least a sample. A paralegal will review it, signed by everyone and then gets recorded and filed.

I think there is a lot of difference from state to state, so you need to Google specifics for yours. In my state (Louisiana) there is no legal separation, so you just go to court when the two parties (both have to appear) will declare under oath that they have lived separate and apart for at least 6 months and desire a divorce. I know plenty of people that did declare under oath prior to 6 months, but I was actually separated for nearly a year. My husband wouldn't show up, so I had to have two witnesses that declared our at least 6 month separation.

If any local lawyers offer a 'free 30-minute initial consult', take advantage of it. (I called/met with 3 or 4 before I got all the info I needed/wanted.) I just said it was mutual, no issues of contention, what's involved and how much will you charge. Then I asked exactly what the fee covered...they usually rhymed off filling out that document, serving this paper and filing that motion.

 

In province of Ontario, a "separation agreement" is also not a legal requirement. We did end up using a lawyer, and never had to go to court at all. Was told judges just 'rubber-stamp' all uncontested applications whenever they have some time to kill.

 

I bought a "how to divorce in ontario" guide at the bookstore. Had all pertinent laws, guidelines, forms and whatever else necessary. Don't know the publisher, so can't say if it might be available in other jurisdictions/countries.
